To access and utilize our services, users are required to create an account. By creating an account, you agree to provide accurate and complete information, including but not limited to your name, email address, and other necessary details. It is your responsibility to maintain the confidentiality of your account credentials and promptly inform us of any unauthorized access or security breaches. Users are solely responsible for all activities conducted through their accounts. We reserve the right to terminate or suspend accounts that violate our terms of service or engage in unauthorized or harmful activities. Your account information will be handled in accordance with our privacy policy. Please review our privacy policy for more information on how we collect, use, and protect your personal data. By using our platform, you acknowledge and agree that Learners HQ cannot be held liable for any unauthorized access to your account or data breaches resulting from your failure to maintain the security of your account credentials. You also agree to promptly notify Learners HQ of any unauthorized use of your account or any other security breach. Learners HQ reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion.
Any individual signed up to Learners HQ will be classed as a member, with the ability to browse and purchase products. If a student also is a Creator please check the terms and conditions below in section 3.
A customer signing up to use Learners HQ must be at a minimum age of 18. If an adult signs up and chooses to have their children or others under the age of 18 to view the content they have purchased, all liability lies with the owner of the account and not Learners HQ to make sure the content viewed is appropriate for the minor.
Customers agree to use the Platform in a manner consistent with all applicable laws and regulations and in accordance with these Terms of Service. Learners HQ reserves the right to suspend or terminate customer accounts that violate these terms or engage in prohibited activities.
By agreeing to the terms of service you agree that the purchase of any product is a transaction between yourself and the teacher you have purchased from. Learners HQ has no liability based on the quality of the course. If it is not to a standard you believe you paid for please look at the refund policy.
Learners HQ has no direct contract with customers. We have a responsibility, however, to make sure the platform is used appropriately in line with the content and behavior policy as well as ensuring the platform is fit for purpose. By using our platform, customers acknowledge and agree that Learners HQ cannot be held liable for any disputes or issues that arise between customers and creators. Learners HQ is not responsible for the content of products or the actions of creators. Customers are encouraged to review course descriptions and ratings before making a purchase and to utilize the refund policy if necessary. Customers also agree to abide by Learners HQ's content and behavior policies, which prohibit the sharing of offensive or inappropriate content and behavior. Learners HQ reserves the right to remove or suspend customer accounts that violate these policies.
All creators must be above the age of 18 with no exceptions.
Creators will be able to set their own prices and there are no caps on the amount a creator can earn from their courses.
Learners HQ will charge 8% per transaction. There will also be a card fee typically around $0.20 + 2.5% directly from the payment provider which will be deducted from the sale. There are no hidden costs.
The minimum product fees including any discounts is $1 for anything that is public on the marketplace. Free courses are able to be made, but these will only show on your profile or landing pages.
The minimum Withdrawal is $100 and will be processed within the first 5 days of the month after you hit $100. This limit is made to reduce transfer fees for the creator due to most providers having a fixed fee + a % charge.
Payments will be made via wire transfer. This will incur fees related to the transfer and any currency conversion. However, if you supply a Wise account to pay to, this fee can be reduced to only currency conversion if necessary.
By agreeing to the terms of service you agree that all purchases of your products are between you and the customer. You are responsible for the level of content and making sure it is of high quality. Learners HQ will take the payments and distribute them less fees to you, make sure all courses adhere to the Content and Behaviour policies and deal with disputes between customers and creators if necessary.
By agreeing to the terms of service you agree that you are a customer of Learners HQ and that you accept the charge of 8% of all sales for use of the services as well as the card processing fees.
There is one price entered for the course. This is the net price and does not include any Sales Tax or Value Added Tax. We will be taking any relevant tax on purchase of the product and paying it to the relevant authority. If you are VAT registered please provide us with your VAT registration number so we can issue your invoices with VAT included.
Unless otherwise specified by law, you are responsible for all taxes (including but not limited to the tax amount itself, as well as any penalties, fines, charges, or late payment interest) related to your sales on the Learners HQ site.
All rights to the content of products remain entirely with the creator. Learners HQ holds no rights over any of the content produced by others.
A product can be taken off the market at any time. However, it can’t be completely removed while there is an active subscriber or if it was bought as part of a lifetime sale. If there are no currently active subscriptions allocated to a product it can be deleted.
You can close your account completely if you wish to. However, you will not be able to do this while you have any active products in place in order to protect students' purchases. By using our platform, creators acknowledge and agree to these Terms of Service, including the provisions related to earnings, payment terms, tax responsibilities, and content rights."
As complying with legislation every contract to supply digital content is to be treated as including a term that the quality of the digital content is satisfactory.
The quality of digital content is satisfactory if it meets the standard that a reasonable person would consider satisfactory, taking account of:
(a)
any description of the digital content,
(b)
the price
(c)
all the other relevant circumstances such as public statements about the product.
If it is found that a seller has misled the buyer before purchase then a full refund will be given. The buyers account may be banned for misleading buyers, but this will be on a case by case basis and a warning may be given first based on the severity of the misleading.
If however the product is as described and is of a standard a reasonable person would consider satisfactory then no refund will be given as you have already received the product purchased.
All requests must be made within 14 days of purchase.
Please contact refunds@learnershq with the details of your purchase and the issue in order to start this process.
If a file/video is corrupted and you can't get access to it we will need to contact the seller to request it to be repaired.
If this file is repaired/replaced to fit the description of the purchase there will be no refund given.
If the seller does not or will not repair/replace the file then a full refund is needed.
All requests must be made within 14 days of purchase.

Report Violations: If you encounter any content that infringes upon copyright or intellectual property rights, please report it to us immediately. We take intellectual property violations seriously and will address them promptly.
Failure to adhere to these guidelines may result in account suspension or other actions to protect the intellectual property rights of our instructors and maintain a safe and respectful learning environment.

Non-Compliance: Failure to comply with applicable laws and regulations, including regional or local legal requirements, may lead to account suspension or termination.
